US Accused Of Violating Trade Rules

US and VIET NAM - The World Trade Organisation (WTO) has released a statement regarding the on-going dispute between Viet Nam and the US over anti- dumping proceedings against certain frozen warmwater shrimp, stating that the US were violating trade rules.

The statement, released on Monday 11 July 2011, determined that the US had acted inconsistently with Article 2.4 of the anti-dumping agreement through its use of the zeroing method which it used to calculate the dumping margins of selected respondents in the administrative reviews.

Viet Nam had challenged certain aspects of the US Department of Commerce (USDOC)'s final determinations in the US anti-dumping proceedings against Certain Frozen Warmwater Shrimp.

In particular, Viet Nam challenged the “continued use”, by the USDOC, of certain practices, as well as their application in the second and third administrative reviews.

The practices challenged by Viet Nam were the following:

  • The USDOC's use of zeroing in the calculation of dumping margins;
  • The USDOC's limitation of the number of exporters or producers selected for individual investigation or review.
